When I log in, the editing tabs dialog sometimes appears. I don't care, so should not be forced to respond in a modal way. The dialog should disappear if I click outside the box or hit <esc>.

It disappears if you press Escape. It wouldn't be a very good modal dialog if it was dismissed by clicking outside it.
Also, it's a one-time-only dialog; pick an option and it's gone forever.
