I'm not sure why L2 was listed as a requirement? The phabricator NDA doesn't really work into any workflow that I'm aware of, we require an NDA on file with WMF legal. (This is not the same as the phabricator one.)

So my understanding is including the L2 is not required. (I'm not sure where it is required.)
