Evaluate if using fair use images in App Store promotion cards and images fall under any fair use policy passed by the board
Open, LowPublic

Description

The iOS app is (by own admission) using fair use images in their promotional images/cards on the app store.

It is true that we do not store these promotional cards on our servers, so the Fair use Wikimedia Foundation Licensing policy resolution of March 23, 2007 might not apply since it is not on one of our own projects, however it is one of our products, and therefore should in my opinion be covered under the same policy. (And if defined not to fall within the policy, we should still try to be consistent and not try to find loopholes such as the different definitions of "projects" and "products". We should still honour the spirit of the policy in all aspects).

On this card, we acknowledge that we are using fair use content to promote our application. That would not be an acceptable fair use rational under any Exemption Doctrine Policy on any project.

@JMinor: This task is about the Wikipedia iOS app. If it should not be tagged with "Wikipedia-iOS-App-Backlog (Administrative)" then which other Wikipedia iOS app project tag should be applied?

@JMinor: No reply; re-adding tag as this seems to be about the Wikipedia iOS mobile app, so that tag should not be removed. If a task should never be implemented/worked on, or has been superseded/done, then the task status should be set accordingly. Thanks.
