Currently the Wikimedia Foundation nomail list is honored by makeMailingList.php. This does not however play into future mailouts in the same election cycle, which use the same mailing list.

I think it would be cleanest to adjust sendMail.php to add an argument to ignore users whose names appear in the nomail list, which would mostly be users who added their names there after the first mailout.
