Perhaps better than this and bug 56866 would be a radio button/dropdown with three options for TOC:
Include an automatic table of contents on this page:

  • Never
  • When there are three or more headings (default)
  • Always

If different wikis (can) have different settings for the number of headings before a TOC then the middle option will need to read that setting.

I say "automatic" above as manual TOC templates such as [[template:Compact ToC]] should always override this setting.
